Following the written request by co-chair Hunko, the Presidential Committee instructed the PACE President, Mr Theodoros Rousopoulos, to request an opinion by the Venice Commission on the decision by the Romanian Constitutional Court to annul the presidential election.
Co-chair Hunko: “It is important to understand if this annulment was consistent with international standards for free and fair elections, as well as the Council of Europe’s rule of law and democratic principles, because it can set a dangerous precedent which might be misused by actors in countries with a weaker or not fully impartial rule of law”.
On 13 December 2024 the PACE Bureau took note that the PACE President will ask the Venice Commission for an urgent opinion on the conditions and the legal standards under which a constitutional court can invalidate elections.
